ICG, icgimpact.com, and its subsidiaries (collectively “ICG”) are committed to protecting the privacy of the companies and individuals that register with and use our website and services. ICG values privacy and is focused on protecting users’ and companies’ data from unauthorized access/use.

This Privacy Policy explains ICG’s collection, use, and disclosure practices surrounding information we automatically collect when you visit our website (www.icgimpact.com), and information you provide to us as explained in further detail below. By using ICG’s website, attending ICG events, and/or receiving ICG marketing communications, you are consenting to the collection, processing, storage, transfer, disclosure, and other uses of your information as described in this following Privacy Policy.

Throughout this policy, we refer to “supervisory authorities.” This could refer to the Federal Trade Commission (FTC) or Information Commissioner’s Office (ICO), depending on jurisdiction and the ICG Services involved in the collection/processing of data.

Collected and Stored Information

We will collect the personal data that you voluntarily provide to us (e.g., when you register for or subscribe to the ICG blog, sign up to receive marketing, or subscribe to the ICG newsletter). We may also collect personal data when you sign up for events or other opportunities through ICG.

Personal data may contain your name, email, contact information, or other information provided by you to ICG.

Statistics and information on your use of the Site including your IP address, device type and unique device identification numbers, device event information, broad geographic location, and other technical data collected through cookies (which GDPR considers to be ”online identifiers”) or other similar technology may be collected.

Cookies—which may include information about you, your preferences, or your device—are mainly used to make the Site work as expected. ICG may use session cookies and persistent cookies for the purpose of tracking various data points. Use of cookies can also help to speed your access to the Site, as cookies serve as “reminders” as to who you are to our programming. ICG will not share your information with third parties, except for third-party vendors and service providers that work with ICG. In those cases, ICG will only share personal information to vendors and service providers to help ICG provide a product or service to you.

Third parties may include our subsidiaries and affiliate companies, Consumer Relationship Managements (CRMs), marketing automation providers, invoicing suppliers, call center operators, shippers, services, information processors, financial institutions, data appending services, surge scoring companies, and professional advisors. These third parties only have access to personal information needed for them to complete their services.

In some situations, ICG may be required to share your data to 1) assist government enforcement agencies; 2) investigate and defend ICG against third-party claims or allegations; and/or 3) protect ICG’s or others’ rights, properties, or personal safety, provided that doing so does not outweigh your personal rights. If ICG is forced to make these additional disclosures, reasonable efforts will always be used to give you prior notice of the disclosure.

International Transfers of Information

Information, including information collected in the in European Economic Area (EEA) may be transferred, stored, and processed by ICG and its affiliates in the United States and other countries whose data protection laws may differ from those of your country. In such cases, ICG will protect your personal data wherever it is processed and take appropriate steps to protect the information in accordance with applicable laws.

Data Retention

By agreeing to this Privacy Policy, you agree that ICG may retain your personal information in connection to delivering Site and Services, in connection with ICG’s routine backup and archiving procedures, and to ensure compliance with ICG’s legal requirements and its continuing obligations under applicable laws, including to protect ICG, ICG affiliates, ICG agents, and others on ICG’s behalf in court and administrative proceedings.

Your Rights Regarding Your Personal Information

General Data Protection Regulation (GDPR)

As of May 25, 2018, EU-based individuals have the right to file a complaint with their local data supervisory authority. They also have certain rights which they may exercise free of charge, including the right to:

  • Access their personal information and certain other supplementary information 
(which this Privacy Policy already addresses);
  • Require the correction of any mistakes in their information;
  • Require the erasure of personal information concerning themselves in certain situations;
  • Receive the personal information concerning themselves which has been provided to sites/services in a structured, commonly-used, machine
  • readable format and have the right to transmit that data to third parties in certain situations;
  • Object to processing of their information for direct marketing at any time;
  • Object to decisions being taken by automatic means which produce legal effects concerning or significantly affecting themselves; and
  • Object to continued processing of their personal information in certain other situations.

California Consumer Privacy Act (CCPA)

For California residents, the CCPA offers important rights which they may exercise, including the right to:

  • Request information regarding policies governing disclosure of personal information to third parties for their direct marketing purposes;
  • Request that their personal information not be sold; and
  • To request the removal of any content (“User Content”) created and publicly posted on a website (for California residents under the age of 18).

ICG will make a good-faith effort to delete User Content from public view as soon as reasonably practicable. However, please note that a request to delete User Contact does not ensure complete or comprehensive removal of User Contact, as it may remain on backup media, be cached or otherwise retained by ICG for administrative or legal purposes, ore remain publicly available if you or someone else has forwarded or reposted it on another website or service prior to its deletion. Additionally, ICG may be required by law to not remove (or allow removal) of your User Content.

Children’s Rights

ICG complies with the Children’s Online Privacy Protection Act of 1998 (COPPA), GDPR, and CCPA. For this reason, ICG does not knowingly collect or maintain any information via the website from persons under the age of sixteen (16), and no part of the Site is directed to persons under the age of sixteen (16). If an underage person provides information and ICG has unknowingly collected said information, it will take the appropriate steps to delete this information immediately upon discovery. Per the CCPA, ICG does not sell data of individuals under the age of sixteen (16) without prior authorization.

Transfer of Rights

Should ICG be acquired, merged, or closed for business, it reserves the right to transfer or assign the information collected during the due course of business. This information may be held as part of any acquisition, merger, sale, or other change of control of business entity status.

Changes and Updates

If ICG changes this privacy policy, those changes will be posted on its Site and in any other places deemed appropriate so that you are aware of the information that ICG collects, uses, and discloses. ICG reserves the right to modify this privacy policy at any time. If material changes to this policy are made, notification will be given by email or a notice on the Site.

Communications

On occasion, ICG may send communications as part of the Service or Site. These may include, but not be limited to, account activity alerts, updates, marketing, and blog posts. Such communications shall originate from ICG and be conducted in compliance with this Privacy Policy. Users may opt out of such communications at any time, as instructed in the email communications.
